INTERNAL REGULATIONS OF THE COMMUNITY OF OWNERS BENAL BEACH, BENALMÁDENA COSTA (MÁLAGA)
These Internal Regulations have been drafted and approved by the General Assembly of the Community of Owners of the Benal Beach Building. Their purpose is to promote good coexistence among residents, as well as to regulate the use and enjoyment of the facilities and common elements.
These rules apply to all owners and to any other person who, for whatever reason, is within the community grounds, whether as a tenant, relative, or guest, i.e., in the capacity of a resident.
The impact of these Regulations will always be for the benefit of the rights of the owners and the full enjoyment of the facilities available in the building. Ignorance of the Rules, Regulations, Horizontal Property Law, Civil Code, and other legal standards shall not grant any right to those who fail to comply with them, to the direct or indirect detriment of the Community. The Community may legally pursue claims and legal proceedings before the competent courts to recover damages caused.
1.1 It is strictly forbidden to use the services and common elements in a manner contrary to their intended purpose.
1.2 Regulations for the disabled shall be respected at all times, and services shall be adapted both for them and for other users of common areas.
1.3 All informative, reminder, or warning signs placed by the Community in designated areas must be obligatorily respected.
1.4 It is forbidden to damage, step on, or remove plants, flowers, or leaves from the interior and/or exterior gardens.
1.5 The use of glass bottles or any sharp objects in the gardens is prohibited.
1.6 Walking barefoot or wet through the building’s corridors and common areas is prohibited due to safety hazards.
2.1 Hanging clothes and/or towels on the main terraces of the apartments is prohibited. Only low drying racks inside balconies may be used, so they are not visible from outside.
2.2 Leaving objects, furniture, or items of any kind in corridors, staircases, or communal areas is prohibited, except those required by fire or safety regulations.
2.3 Placing FOR SALE or FOR RENT signs on terraces or visible areas is prohibited; only the designated notice board may be used.
2.4 Air conditioning units must be installed at terrace floor level to avoid visibility from outside.
2.5 Terrace drains must not discharge air conditioning water or any other water, as this harms neighbors below.
2.6 Owners are responsible for cleaning, upkeep, and maintenance of their terrace floors, as they are private elements.
2.7 Approved awnings are striped in vanilla and coffee colors (Manufacturer: SATTLER, Model Reference: 320 062). Their upkeep is the owner’s responsibility.
2.8 Entrance doors may not be replaced with any different model than that approved by the General Meeting.
2.9 Any terrace enclosures not approved by the General Meeting are prohibited.
2.10 Any works on the façade or common elements require express approval by the General Assembly, per Article 7 of the Horizontal Property Law.
3.0 Before beginning any work, the owner must sign the document included as Annex 2 of these regulations.
3.1 Masonry, plumbing, painting, or other works requiring material transport are prohibited between July 1 and August 31, to avoid disturbing residents during peak season.
3.2 During those dates, only emergency repairs due to serious damage are permitted. Debris containers must be placed outside the parking area.
3.3 Works that alter the building’s architectural structure, safety, or external appearance in a way that harms other owners are prohibited.
3.4 Dumping debris, furniture, or appliances in garbage rooms is strictly forbidden.
3.5 Any owner wishing to carry out noisy works must notify the administration with apartment number, estimated start, and finish dates.
3.6 The owner is responsible for cleaning or repairing any damage caused to communal areas; the administration may claim costs.
3.7 Noisy works may only take place from 10:00 to 14:00 and 16:30 to 20:00.
4.1 Activities producing noise or disturbance are strictly prohibited, especially between 11:00 p.m. and 10:00 a.m.
5.1 Leaving bags or containers outside the designated bins is strictly prohibited. Large items must be left by exterior containers on collection days or scheduled via Reception for removal.
5.2 Household garbage must always be disposed of in closed plastic bags, placed inside designated garbage room containers.
5.3 Throwing any objects or garbage from terraces is prohibited.
6.1 Pet owners must comply with the following rules, in addition to official regulations.
6.2 Dogs must always be on a leash and muzzled. They may not roam freely.
6.3 Pets are prohibited in gardens, pools, or communal areas.
6.4 Pet owners must pick up waste and leave the area clean.
6.5 Pets must have proper health documentation.
6.6 Owners must prevent pet noise during rest hours stated in Article 4.1.
7.1 Children may not be in gardens, corridors, or communal areas unless accompanied by an adult, due to safety hazards (lakes, waterfalls, etc.).
7.2 Riding bicycles, skateboards, or roller skates in corridors, stairwells, or gardens is prohibited, as are noisy activities.
7.3 Ball games or similar are prohibited in portals, corridors, stairs, or squares; only designated play areas may be used.
8.1 Disabled spaces may only be used by authorized vehicles with proper documentation.
8.2 Parking that blocks traffic or other cars is prohibited.
8.3 Emergency access (ambulance, police, fire trucks) must never be blocked, especially at the main entrance.
8.4 Category 2 or 3 vehicles may not park on-site, even if owned by residents, due to space restrictions. No vehicle may occupy more than one space.
8.5 Motorbikes and bicycles may only park in their designated areas.
9.1 Capacity limits (weight and number of persons) must not be exceeded. Abuse entails responsibility for damages.
9.2 Minors may not use elevators unless accompanied by an adult.
9.3 Transporting oversized or overweight items that could damage elevators is prohibited.
9.4 Only community staff may supervise elevator maintenance. Residents must not tamper with mechanisms. Malfunctions must be reported.
10.1 Pools will open according to the schedule set annually, posted on notice boards.
10.2 Bathing is prohibited outside operating hours or when no lifeguard is present. The community accepts no liability for accidents.
10.3 Entry requires a valid card or bracelet issued each season:
11.1 These regulations apply equally to owners, tenants, usufructuaries, or any other occupants.
11.2 The community may demand compensation for damages from occupants, without prejudice to the owner’s direct responsibility.
11.3 Owners are recommended to place a copy of these rules inside apartments rented to third parties.
11.4 To preserve image, civility, and residents’ rest, the number of occupants per apartment must not exceed:
People who disturb community peace at Benal Beach (fights, noise, unruly behavior, etc.) may be expelled and will be held financially responsible for any damages caused. Apartments may be closed for up to 3 years, with the offender bearing all losses.
Alcohol consumption in corridors, entrances, reception, gardens, etc. is strictly prohibited. Botellón (street drinking parties) is absolutely forbidden.
